TERMS AND CONDITIONS - DISCLAIMER
This service is a way for Tourists and Tour Operators to find and contact Tourist Guides online. This service is provided by Tourguide.co.za. This is a legal contract between you and Tourguide.co.za. Please read this agreement carefully before registering. By registering, you become a member of Tourguide.co.za and you agree to be bound by the terms and conditions of this agreement for the duration of your membership. If you do not agree to the terms, please do not register for the Tourguide.co.za service. The terms of this agreement are subject to change by Tourguide at any time, effective upon notice to you.

ONLINE CONDUCT
As a Member, you agree as follows: Your membership is for your sole, personal use. You may not authorize others to use your membership, and you may not assign or otherwise transfer your account to any other person or entity. You are solely responsible for the content of information you publish or display ("post") on the service or transmit to other Members/Users. You will not post or transmit to other Members/Users or Employees any item that is defamatory, inaccurate, abusive, obscene, profane, offensive sexually oriented, threatening, harassing, racially offensive or illegal, or any material that infringes or violates another's rights (including but not limited to intellectual property rights and rights of privacy and publicity). You will not include sexually suggestive descriptions, or photo's containing nudity. Tourguide.co.za reserves the right, but has no obligation, to reject any profile or photo that does not comply with these prohibitions. You will not transmit any chain letters or junk E-mail to other Members/Users. You are solely responsible for your own interactions with other Members/Users. Tourguide.co.za reserves the right but is under no obligation or duty to monitor disputes between you and other Members/Users.

INDEMNITY BY MEMBER
You agree to defend, indemnify and hold harmless Tourguide.co.za, its officers, directors, employees, agents and third parties, from any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use and activities while using the Tourguide.co.za service, including any breach by you of the terms of this Agreement.

TERMINATION OF MEMBERSHIP
Tourguide.co.za reserves the right to immediately suspend or terminate your access to the Tourguide.co.za service, without notice, upon your breach of any of the terms of this Agreement.

To resolve a complaint regarding the Tourguide.co.za service, you should contact Tourguide.co.za Customer Support via email at info @ tourguide .co.za

CONFIDENTIALITY OF INFORMATION SUPPLIED BY MEMBERS
Tourguide.co.za will keep confidential all information supplied by you to Tourguide.co.za, including credit card number(s), and shall use or disclose such information only for the purposes for which such information was collected, or as required by law.

ONLINE MATERIAL CONTENT
Opinions, advise, statements, offers, or other information or content made available through the Tourguide.co.za service are those of their respective authors and not of Tourguide.co.za, and should not necessarily be relied upon. Such authors are solely responsible for such content. Tourguide.co.za does not guarantee the accuracy, completeness or usefulness of any information on the service and neither adopts nor endorses nor is responsible for the accuracy or reliability or any opinion, advice or statement made. Under no circumstances will Tourguide.co.za be responsible for any loss or damage resulting from anyone's reliance on information or other content posted on the service or transmitted to other Members/Users.

MEMBERSHIP SUBSCRIPTIONS
Tourguide.co.za is a free service, however Tourguide.co.za may charge subscription fees for using the website. These fees may be adjusted at any time, subject to 30 days notification of it's members. Refunds will only be given at the discretion of management.

WARNING
It is possible that other Members or users (including unauthorized users or "hackers") may post or transmit offensive or obscene materials on the service and that you may be involuntarily exposed to such offensive or obscene materials. It is also possible for others to obtain personal information about you due to your use of the service, and that the recipient may use such information to harass or injure you. Because of these concerns, please carefully select the type of information that you post on the service or release to others. Tourguide.co.za is not responsible for the use of any personal information that you may choose to disclose on the service. Tourguide.co.za reserves the right, but has no obligation, to monitor the materials posted in the public areas of the Tourguide.co.za service. Tourguide.co.za shall have the right to remove any such material that violates or is alleged to violate any law or this Agreement. Notwithstanding this right, you remain solely responsible for the content of the materials you post in the public areas of the service and your private E-mail messages. Tourguide.co.za will treat E-mails sent between you and other Members/Users as private. Tourguide.co.za may review private content if cause has been established for such an action, based on reports or suspicion of violation of terms and conditions of this agreement.

PROPRIETARY INTERESTS AND RIGHTS
Tourguide.co.za owns and retains other proprietary rights in the Tourguide.co.za service. The service contains the copyrighted material, trademarks and other proprietary information of Tourguide.co.za and its licensors. In addition, other Members/Users may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which in the public domain or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display or sell any such proprietary information. By positing information or content to any public area of the Tourguide.co.za service, you automatically grant, and you represent and warrant that you have the right to grant, to Tourguide.co.za and the other Members/Users an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of or incorporate into other works such information and content, and to grant and authorize sublicenses of the foregoing.

DISCLAIMER OF WARRANTY
Tourguide.co.za provides the Tourguide.co.za service on an "as is" basis and grants no warranties of any kind, express, implied or statutory, in any communication with Tourguide.co.za or its representatives or otherwise with respect to the service. Tourguide.co.za specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, or noninfringement. Tourguide.co.za does not warrant that your use of the Tourguide.co.za service will be secure, uninterrupted,always available or error free, or will meet your requirements, or that any defects in the Service will be corrected. Tourguide.co.za disclaims liability for, and no warranty is made with respect to, telecommunication service including coverage, range or any interruption in telephone service.

LIMITATION OF LIABILITY
In no event with Tourguide.co.za be liable to you for any incidental, consequential or indirect damages (including but not limited to damages for loss of data, loss of programs, cost of procurement of substitute services or service interruptions) arising out of the use of or inability to use the Tourguide.co.za service, even if Tourguide.co.za or its agents or representatives known or have been advised of the possibility of such damages, or to any person other than you. Notwithstanding anything herein to the contrary, Tourguide.co.za's liability to you for any cause whatsoever and regardless of the form of the action will at all times be limited to the amount paid by you to Tourguide.co.za, if any, for the service during the term of your membership. Tourguide.co.za does not screen Members/Users registering on the Tourguide.co.za service, therefore, Tourguide.co.za will not be liable for any damages arising out of the use of this service, including incidental, consequential, direct or indirect damages. This also includes, without limitation, to damages arising from communicating and/or meeting with other Members/Users of this service, or introduced to you via this service. Such damages include, without limitation, physical damages, bodily harm and/or emotional distress and discomfort.
